Lect. Noor Ameen Ahmed.
The book, which was issued by the Academic Center for Publishing and Distribution, shed light on the idea of presumption in the most important pillar of civil liability, which is damage, that leads to relieve the creditor of the burden of proving its occurrence, and thus establishing civil liability without requiring that item because it has been assumed by law. This leads to the brevity in the procedures that must be followed in order to get compensation.
The book reached some results; the most notable of which is that the supposed harm is one of the ideas that the logical formulation of the texts came up with in an attempt to find a legislative formulation that suits the legitimacy of the assumption, as well as an embodiment of the legislator’s desire to grant the privilege for which the assumption was legislated. It became clear to the authors that the idea of assuming harm has Philosophical principles can be explained from two perspectives. The first is the legal which results from the prevailing belief that the occurrence of that harm has been confirmed.
This book is an important and valuable addition to the legal library and a scientific achievement in the field of civil law. It represents an additional scientific step on the path to science, knowledge and legal culture as well as an important source for researchers and graduate students in the field of civil law.
